b. Payment: We accept payment via Visa and MasterCard, and Bank Transfer. All payments are processed securely. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

c. Order Confirmation: Upon successful payment, you will receive an order confirmation email. This email does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order.

d. Order Acceptance: Your order is accepted when we dispatch the product(s) or provide you with access to the service. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. If your order is canceled after your credit card has been charged, we will issue a credit to your account in the amount of the charge.

a. Delivery Methods: We deliver via store pickup and local courier. For local courier, the delivery costs and estimated delivery times are provided at checkout.

b. Delivery: We aim to deliver products within the estimated timeframe, but delays may occur due to unforeseen circumstances. We are not responsible for delays caused by the shipping carrier or customs.

c. Risk of Loss: All items purchased from us are made pursuant to a delivery/shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

7. Returns and Refunds

At KRISTAL Media, we are committed to providing quality products and services. However, in the event that a purchase does not meet your expectations, we offer a refund policy under specific conditions.

  1. Eligibility for Refunds

We accept refunds only if all of the following conditions are met:

  • Defective or Incorrect Item: The purchased item is defective, or the wrong item was delivered/picked up. In this case, the customer is entitled to a replacement with the correct item.
  • Replacement Unavailable: If a replacement is not available, the customer will be eligible for a refund.
  1. Conditions for Refund

To qualify for a refund:

  • The item must be returned in its original packaging and condition, unused, and undamaged.
  • The refund request must be made within 7 days of receiving/picking up the item.
  • Proof of purchase is required.
  1. Non-Refundable Items

The following items are not eligible for refunds:

  • Sale or promotional items.
  • Products that show signs of use, damage, or tampering not caused by us.
  • Gift cards and downloadable products.
  1. Refund Process

Once the returned item is received and inspected, we will notify you of the approval or rejection of your refund.

  • Approval: If approved, a refund will be processed to your original method of payment within 14 to 30 business days.
  • Rejection: If the refund is not approved, the item will be returned to you.

8. Consignment Agreement

Consignment Agreement

This Consignment Agreement (the “Agreement”) is made and entered into by and between The KRISTAL Store (hereinafter referred to as “Consignee“) and the individual or entity or seller submitting goods for sale (hereinafter referred to as “Consignor“).

  1. Consignment of Goods
  • 1.1. Acceptance of Items: The Consignee reserves the right to accept or reject any item submitted for consignment at its sole discretion. Items must be of high quality, in good condition, and suitable for sale through The KRISTAL Store.
  • 1.2. Item Description and Pricing: The Consignor must provide a detailed and accurate description of each item. The Consignee, in consultation with the Consignor, will determine the final selling price for all items to adjust for our commission, delivery costs, and bank charges.
  • 1.3. Ownership: The Consignor represents and warrants that they are the legal owner of all consigned items and have the right to sell them. The Consignor agrees to indemnify and hold the Consignee harmless from any and all claims, demands, or actions arising from any alleged ownership disputes.
  1. Sale and Payment
  • 2.1. Term: The consignment term for each item is for an indefinite period, beginning on the date the item is listed for sale on The KRISTAL Store website. The consignment will continue until terminated by either party as outlined in Section 4.
  • 2.2. Commission: The Consignee will retain a commission of 10% of the final sale price of each item sold. The remaining percentage of the final sale price will be paid to the Consignor.
  • 2.3. Payouts: Payouts to the Consignor will be made on a monthly basis, within 15 business days of the end of each month. Payments will be made via bank transfer to the Consignor’s bank account.
  • 2.4. Unsold Items: Should an item remain unsold after the consignment term is terminated by either party, the Consignee will notify the Consignor. The Consignor then has 30 days from the date of that notification to arrange for the item’s return at their own expense. If the Consignor fails to retrieve the item within this timeframe, the item will become the property of The KRISTAL Store and may be donated or disposed of.
  1. Responsibilities
  • 3.1. Consignor’s Responsibility: The Consignor is responsible for accurately describing the items and ensuring they are in the condition specified. For products requiring delicate handling or special storage, the Consignor may store the items at their own business location. Once an item is sold, the Consignor is responsible for preparing it for pickup by our delivery courier. For items stored at The KRISTAL Store’s business location, the Consignor is also responsible for providing all necessary packaging materials, such as packing bags, boxes, and other required supplies.
  • 3.2. Consignee’s Responsibility: The KRISTAL Store will handle the marketing and sale of the consigned items. We will take reasonable care to protect the items from damage or loss but will not be held liable for damage, theft, or loss due to circumstances beyond our control.
  • 3.3. Delivery and Logistics:
    • When items stored in The KRISTAL Store’s business location is sold, we will appoint a local delivery courier to transport the item from our business location directly to the customer’s address. The delivery cost will be borne by us.
    • When items stored in the Consignor’s business location is sold, The KRISTAL Store will appoint a local delivery courier to transport the item from the Consignor’s business location directly to the customer’s address. While The KRISTAL Store covers the delivery cost, any additional charges from the courier will be borne by the Consignor and will be deducted from the Consignor’s payout. Upon notification from The KRISTAL Store, the Consignor must ensure the item is ready for pickup by the agreed-upon date and time.
  1. Termination of Agreement
  • 4.1. Termination by Consignor: The Consignor may request the return of their items at any time, but the Consignor then has 30 days from the date of the request to arrange for the item’s return at their own expense. If the Consignor fails to retrieve the item within this timeframe, the item will become the property of The KRISTAL Store and may be donated or disposed of.
  • 4.2. Termination by Consignee: The KRISTAL Store may terminate this Agreement and return items to the Consignor at any time, with or without cause.
  1. General Provisions
  • Entire Agreement: This Agreement constitutes the entire agreement between the Consignor and the Consignee and supersedes all prior agreements, understandings, and negotiations.

 

By submitting items for consignment, the Consignor agrees to the terms and conditions outlined in this Agreement.

9. User Accounts

a. Account Creation: To access certain features of our Website, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

b. Account Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

c. Account Termination: We reserve the right to terminate or suspend your account, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

In no event shall KRISTAL Media Sdn. Bhd., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any conduct or content of any third party on the Website; (iii) any content obtained from the Website; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

What constitutes a material change will be determined at our sole discretion.
